The President’s Message…
Dear Colleagues,
I have some exciting news to share! APSCUF has prevailed in arbitration over a grievance
regarding the use of student-to-faculty ratios as a reason for retrenching faculty. In 2021 and
2022, the requirement that universities meet the ‘Greenstein ratios’ resulted in the
retrenchment of 114 faculty members across PASSHE. APSCUF argued in the grievance that
the ratios were arbitrary in nature, misrepresented the actual practice of teaching in higher education, and that by
using only the ratios to justify retrenchment, PASSHE failed to meet and discuss in good faith about ways to prevent
retrenchment of faculty, which is a requirement of the CBA.
Here is a summary of the ruling: Arbitrator Mattye Gandel ruled after careful analysis of the alleged violation of
Article 29 Retrenchment that the State System of Higher Education violated the CBA, when it failed to meet and
discuss in good faith with the Union before and after the Chancellor issued a mandate to reduce the faculty
workforce. The award called for those faculty members, who were improperly retrenched at the end of the 2021 or
2022 school years due to the violation of Article 29, shall be reinstated and made whole for lost wages, seniority and
fringe benefits. Additional meet and discuss shall be held immediately to discuss possible retrenchments scheduled
for the end of the upcoming school years of 2023, 2024 and beyond.
The details of how to implement this decision must still be worked out and PASSHE will almost certainly file an
appeal with the Commonwealth Court, but this is a huge win for APSCUF and a testament to the work of your
APSCUF leadership and our dedicated Labor Relations staff in Harrisburg! (Note that because the State System has
not yet indicated whether it will appeal, we cannot yet discuss or comment on the case publicly. Publicly discussing
pending litigation would be detrimental to APSCUF and could jeopardize the conclusion of this case, as well as
future grievances.)
On a different subject, negotiations for a new contract are ongoing, as our current contract expires on June 30,
2023. Negotiators have discussed joint appointments, expansion of bereavement leave, flexibility of office hours,
and the workload of department chairs. Don’t be worried if you don’t hear many details about negotiations any
time soon; it’s typical that the negotiations are kept in strict confidence. The key thing you can do at this time is to
pay attention to emails from Jan Walters, state APSCUF, or me. For example, we need to collect and/or confirm offcampus contact information. There is no indication at this time that we will go on strike again, but there is always

that possibility and we need to be prepared. My standard advice for faculty members at this point is to try to ready
your finances for a job action. In particular, consider postponing any large purchases as much as possible.

ATTENTION FACULTY: 20/26 ANNUAL PAY OPTION WINDOW APRIL 1, 2023 THRU APRIL 30, 2023
Nine-month pay faculty who are interested in changing their pay options from 20 to 26 pays, or vice versa,
may do so during a window period from April 1, 2023 to April 30, 2023. The change will be effective for the
first paycheck of the Fall 2022 semester which will be on September 22, 2023. (For more informaiton, please
read pages 9-11 in this newsletter.)
If you so choose to change your option, please complete the 20/26 Pay Option form and return it to our
Human Resources office in Carrier between April 1 and April 30th. Please do not return the form to our
APSCUF office nor to the State APSCUF office.
NOTE: This is the only opportunity to make this change during this academic year. The form was attached
to the email announcement or you can request the form from our Human Resources office.
